What this covers

In short: How to tell us that something on decomall.gift infringes your copyright, and how we respond, under the DMCA.

DecoMall resells official Discord Shop items, delivered as discord.gift links. The site shows product names and preview art for those items, our own text and artwork, and reviews written by customers whose orders were delivered.

If you believe something on decomall.gift infringes a copyright you own or are authorized to act for, you can ask us to remove it under the Digital Millennium Copyright Act (17 U.S.C. §512). This page explains how, and how we respond.

Sending a takedown notice

In short: Email us a written notice with the six things the law requires: a signature, the work, where the copy is, how to reach you, and two statements.

Email a written notice to support@decomall.gift. Under §512(c)(3), it must include:

  1. Your physical or electronic signature, as the copyright owner or a person authorized to act for them.
  2. The copyrighted work you say is infringed, or a representative list if several works are covered by one notice.
  3. The material you say is infringing, with enough detail for us to find it, ideally the exact page address on decomall.gift.
  4. Your name, postal address, phone number and email address.
  5. A statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

A notice missing these elements may not be valid. Knowingly misrepresenting that material is infringing can make you liable for damages under §512(f), so if you aren't sure, consider getting legal advice first.

What we do with a notice

In short: We promptly remove or disable the material named in a valid notice, and tell the person who posted it, if anyone did.

When we receive a valid notice, we promptly remove or disable access to the material it identifies. If the material was posted by someone else, such as a customer review, we let that person know and send them a copy of the notice, so they can respond with a counter-notice.

Sending a counter-notice

In short: If your material was removed by mistake, send a counter-notice. We forward it to the claimant and restore the material in 10 to 14 business days unless they go to court.

If you believe material you posted was removed by mistake or misidentification, email us a counter-notice at the same address. Under §512(g)(3), it must include:

  1. Your physical or electronic signature.
  2. The material that was removed and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification.
  4. Your name, postal address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if you're outside the United States, any judicial district where DecoMall may be found), and that you will accept service of process from the person who sent the original notice, or their agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them we will restore the material in 10 business days. We restore it no sooner than 10 and no later than 14 business days after receiving your counter-notice, unless they first tell us they have filed a court action to stop you from posting it.

Repeat infringers

In short: We close the accounts of, and stop serving, people who repeatedly infringe copyright.

In appropriate circumstances, we close the accounts of people who repeatedly infringe copyright and refuse them further service, including placing orders and posting reviews. See also our acceptable use policy.

Where to send notices

In short: Email takedown notices and counter-notices to support@decomall.gift, with "Copyright notice" in the subject.

Email takedown notices and counter-notices to support@decomall.gift, with "Copyright notice" in the subject line, so they reach the right person quickly. A scanned or electronic signature is fine.
